1. Agreement
By accessing or using Creator Operator ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service. The Service is operated by Creator Operator ("we", "us", "our").
2. The Service
Creator Operator provides an AI-assisted operator workflow for content creators, including phone and SMS-based content planning, lead handling, approvals, and weekly reports. Features may evolve, be added, or be removed at our discretion during and after the private beta.
3. Beta program
During the private beta, the Service is provided as-is for evaluation purposes. Setup fees are waived for beta participants. Performance, uptime, and accuracy are not guaranteed during this period. We may contact you for feedback.
4. Subscription & billing
Paid plans are billed monthly in advance at the stated price ($149/month at launch). After the beta period ends, new customers may be charged a one-time setup fee in addition to the monthly subscription. Payments are processed by Stripe. You authorize us to charge your payment method on a recurring basis until you cancel. You can cancel at any time from your billing portal; cancellation takes effect at the end of the current billing period and no refunds are issued for partial months.
5. Content approval & responsibility
You are responsible for reviewing and approving any content, message, or action proposed by the operator before it is published or sent. You retain ownership of your content and remain solely responsible for compliance with the rules of any third-party platform you use the Service with (Instagram, TikTok, YouTube, X, etc.).
6. Acceptable use
You agree not to use the Service to: (a) violate any law or third-party rights; (b) send spam, harassment, or unsolicited bulk communications; (c) impersonate another person; (d) attempt to reverse engineer, disrupt, or gain unauthorized access to the Service; or (e) generate content that is illegal, defamatory, or sexually explicit involving minors.
7. Third-party services
The Service integrates with third-party providers including Stripe, Twilio, OpenAI, Telegram, Buffer, and others. Your use of those services is subject to their own terms. We are not responsible for outages, changes, or actions of third-party providers.
8. Intellectual property
All software, branding, and proprietary materials of Creator Operator remain our property. We grant you a limited, non-exclusive, non-transferable right to use the Service during your active subscription.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated output will be accurate.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
11. Termination
We may suspend or terminate your access at any time for breach of these Terms or for any other reason on reasonable notice. You may stop using the Service at any time by cancelling your subscription.
12. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
